Terms and Conditions

Introduction

This page outlines the terms and conditions for NSW GLASS MASTERS PTY LTD ACN: 679 543 901, trading as NSW GLASS MASTERS ABN: 57 679 543 901. By accepting our quotation, you agree to comply with and be bound by the following terms and conditions.

Agreement

1. Whole Agreement: This quotation embodies the entire agreement between the Customer and NSW GLASS MASTERS, superseding all prior oral or written negotiations or communications by either party. Any variations to this agreement must be in writing and signed by both parties.

2. Acceptance of Quotation: Upon signing the order and/or payment of the deposit, all quotation details are deemed correct and agreed upon by the Customer. NSW GLASS MASTERS is not obliged to perform any work not specifically mentioned in the quotation. Any additional work requested by the Customer will incur extra costs.

Payment

3. Balance of Payment: Payment is due upon completion of works and must be made to NSW GLASS MASTERS. If there are minor outstanding works, the Customer may withhold an amount equal to the value of the incomplete work until it is finished.

4. Ownership of Goods: Ownership of supplied goods passes to the Customer upon full payment of all amounts due under the quotation.

Delivery and Installation

5. Delivery and Installation Dates: Any delivery or installation dates provided are approximate. NSW GLASS MASTERS accepts no liability for delays caused by material shortages or circumstances beyond its control.

6. Window Furnishings: NSW GLASS MASTERS is not responsible for the cost of altering window furnishings that may not fit after window installation unless explicitly stated in the quotation.

7. Exclusions: The quotation does not include allowances for on-site painting, staining, or battening of power lines. NSW GLASS MASTERS will not be liable for costs associated with these exclusions.

Structural Integrity and Damage

8. Existing Structural Faults: NSW GLASS MASTERS will make efforts to detect existing structural faults at the worksite. However, any damage resulting from existing faults will incur additional costs to the Customer.

9. Final Installation Method: NSW GLASS MASTERS reserves the right to determine the final installation method based on structural necessities.

Permits and Approvals

10. Statutory Approvals: Unless specified in the contract, NSW GLASS MASTERS has not made provisions for obtaining local statutory approval permits, architectural drawings, or Home Owners Warranty Insurance. The Customer is responsible for these costs.

Cancellation and Termination

11. Cancellation by Company: Acceptance of the quotation is subject to our works manager’s site inspection. If NSW GLASS MASTERS cancels the quotation, all monies paid by the Customer will be refunded.

12. Termination by Customer: The Customer may terminate the agreement by giving written notice to NSW GLASS MASTERS within ten days of the agreement date.

Access and Equipment

13. Access Requirements: The quotation assumes there is suitable close and easy access to carry materials to the installation area. Additional costs for necessary scaffolding, lifting equipment, and hoisting will be borne by the Customer unless specified otherwise.

14. Licensed Glaziers: NSW GLASS MASTERS guarantees that all staff and contractors hold the appropriate licenses and insurance for glazing work. For jobs exceeding $5000, license numbers will be provided upon request.

Builders Responsibility

15. Modifications: The Customer is responsible for any cutting, modification, or making good of ceiling tiles, plaster, grids, or bulkhead linings.

Project Timing and Variations

16. Project Timing: Project timing starts from receipt of a written order and credit approval, if relevant. Lead times depend on the availability of exact site dimensions and confirmation of all finishes.

17. Variations: Any additions or changes after contract signing will be considered variations. These must be accepted in writing, and a deposit must be paid.
