Introduction
This page outlines the terms and conditions for NSW GLASS MASTERS PTY LTD ACN: 679 543 901, trading as NSW GLASS MASTERS ABN: 57 679 543 901. By accepting our quotation, you agree to comply with and be bound by the following terms and conditions.
Agreement
NSW Glass Masters – Terms & Conditions
1. Definitions
“Company” refers to NSW Glass Masters and its authorised representatives.
“Customer” refers to the person or entity requesting goods and/or services from the Company.
“Goods” means all glass products, hardware, fittings, and associated items supplied by the Company.
“Services” means any installation, repair, replacement, or related work carried out by the Company.
2. Quotations & Orders
2.1 All quotations are valid for 14 days unless otherwise stated.
2.2 Acceptance of a quotation, verbally or in writing, constitutes agreement to these Terms & Conditions.
2.3 A deposit as specified on the quotation is required before any materials are ordered or work is scheduled.
3. Customer-Provided Measurements, Drawings & Specifications
3.1 Where the Customer provides their own drawings, designs, sketches, measurements, or specifications, the Company will manufacture and/or install goods in accordance with that information.
3.2 The Customer bears full responsibility for the accuracy, correctness, and suitability of any such information provided.
3.3 If the Company confirms these details with the Customer (whether verbally, via email, text message, or other method), such confirmation will be deemed the Customer’s final approval. Once approved, the Company will proceed with manufacturing or ordering, and the Customer accepts full liability for any errors, omissions, or inaccuracies.
3.4 The Company is not responsible for incorrect measurements or specifications provided or confirmed by the Customer, regardless of whether the Company queried or sought clarification before ordering.
3.5 Any replacement, alteration, or additional costs resulting from incorrect Customer-supplied information will be charged to the Customer in full. Deposits are strictly non-refundable in such cases.
4. Company-Measured Jobs
4.1 Where the Customer engages the Company to undertake site measurements, the Company will ensure reasonable accuracy within standard industry tolerances.
4.2 The Customer must ensure clear access for accurate measurements. Any obstruction or condition that prevents correct measuring will be noted, and subsequent adjustments may incur additional charges.
5. Deposits & Payments
5.1 All deposits are non-refundable once materials have been ordered, glass has been cut, or work has been scheduled, except where required by law.
5.2 If a job cannot proceed due to inaccurate information provided by the Customer, refusal to approve a required variation, site conditions preventing installation, or the Customer deciding not to proceed, the deposit will be retained by the Company to cover costs, materials, and time.
5.3 Final payment is due immediately upon completion of work unless otherwise agreed in writing.
6. Installation Conditions
6.1 The Customer is responsible for ensuring the installation site is ready, structurally suitable, and compliant with relevant building codes prior to installation.
6.2 Where installation requires specific positioning (e.g., pool fence glass alignment, setback from wall edges, or stepped wall installations), the Company will install according to the agreed design and tolerances.
6.3 Standard tolerance for glass positioning is ±3mm unless otherwise specified in writing.
6.4 For pool fencing, the Company will comply with AS1926.1 and other relevant pool safety regulations. Where alignment or spacing is critical to match existing panels, the Customer must confirm acceptance of the positioning prior to installation.
7. Liability & Warranty
7.1 The Company’s liability is limited to the replacement or repair of defective goods or re-performance of services to the extent required by law.
7.2 The Company is not liable for:
Incorrect measurements or specifications provided or confirmed by the Customer.
Damage caused by misuse, neglect, modification, or improper maintenance.
Delays caused by suppliers, freight, weather, or other events outside the Company’s control.
7.3 All glass is manufactured to industry standards. Variations such as minor scratches, inclusions, or colour shifts within accepted tolerances are not considered defects.
8. Changes, Cancellations & Variations
8.1 Once an order has been placed, changes or cancellations may incur additional charges.
8.2 Any variation to the scope of work must be agreed to in writing and will be charged at the applicable rate.
8.3 If a Customer refuses a required variation due to unforeseen site conditions, and the original installation cannot proceed, the deposit will be forfeited.
9. Governing Law
These Terms & Conditions are governed by the laws of New South Wales, and both parties submit to the exclusive jurisdiction of its courts.
